Terms of sale

1. Seller identification
The website www.drapeur.com is operated by DRAPEUR, a French single-shareholder simplified joint-stock company (SASU) with share capital of €10,000, registered with the Bayonne Trade and Companies Register under number 800 344 814, SIRET 800 344 814 00069, intra-community VAT number FR50800344814.

These terms apply to online sales of clothing, footwear and accessories to consumers. The applicable version is the one communicated when the order is placed. Subsequent changes do not alter the terms of an order already concluded.
2. Products and prices
The essential characteristics, sizes and prices of products are shown on their product pages. Offers are subject to stock availability. Photographs illustrate the products; differences in screen rendering do not affect the customer's right to receive a product that matches its description.
Prices are stated in euros. Applicable taxes and delivery charges are specified before the order is confirmed. Drapeur may change prices for future orders; the price applicable to an order is the price displayed when it is confirmed.
For deliveries subject to import formalities, customs duties, taxes or clearance fees may be charged by the authorities or the carrier in the destination country, according to local regulations and the conditions stated when ordering.
3. Orders and payment
The customer selects items and their options, checks the cart, enters the information needed for the order, and chooses from the available delivery and payment methods. Before confirming an order with an obligation to pay, the customer can check the order details and total amount and correct any input errors.
Available payment methods are displayed during ordering. The website offers, among other methods, PayPal and payment in three instalments with Scalapay. Access to instalment payments depends on the provider's eligibility conditions; the payment schedule and applicable conditions are presented before confirmation. Customers must never email their payment login credentials or card security code to customer service.
The customer must provide accurate contact details, particularly for delivery and communications about the order. If an ordered item is exceptionally unavailable, Drapeur informs the customer and offers a solution accepted by the customer or a refund for the unavailable item. Store credit is never imposed instead of a refund that is due. The customer may save or print these terms.
4. Shipping and delivery
Orders are prepared in Biarritz and dispatched with Chronopost. The stated average preparation time is 24 hours, Monday to Friday. It may vary, particularly during busy periods. Preparation time is separate from transit time.
Delivery methods, times and prices by destination are set out on the Shipping & Delivery page. Applicable charges are communicated before the order is placed. Tracking information is emailed. Showroom collection is available once availability is confirmed.
For a delay, damaged parcel or non-delivery, the customer can contact contact@drapeur.com. Drapeur remains responsible for proper fulfilment of the order under the conditions provided by law; an incident attributable to the carrier does not remove the customer's rights.
If delivery is not made within the agreed period, the customer has the remedies provided by Articles L. 216-1 et seq. of the French Consumer Code, including, under the statutory conditions, the right to terminate the contract after an unsuccessful request for delivery within a reasonable additional period. Termination may be immediate in the cases provided by law. The refund is then made within fourteen days of termination.
The risk of loss or damage passes to the customer when the customer, or a third party designated by them other than the carrier, takes physical possession of the goods, subject to the statutory exception where the customer independently chooses a carrier not offered by Drapeur.
5. Returns and right of withdrawal
Drapeur allows a return to be requested within fifteen calendar days after receipt of the parcel, under its return policy. This commercial option does not limit the statutory right of withdrawal or statutory guarantees.
The consumer has a statutory period of fourteen days to notify withdrawal without giving a reason. This period starts when the customer, or a third party designated by them other than the carrier, receives the goods. For an order containing several goods delivered separately, it starts upon receipt of the last item. The day of receipt is not counted. If the final day is a Saturday, Sunday, public holiday or non-working day, the period is extended to the next working day.
The request can be registered through the returns portal. The customer may also notify withdrawal through an unequivocal statement sent to contact@drapeur.com or by post to DRAPEUR, 27 avenue de Migron, 64200 Biarritz, France, including by using the form in the appendix. The portal is not the only way to notify withdrawal.
The goods must be dispatched without undue delay and no later than fourteen days after the return request to the address above. This period also applies to a request made on the fifteenth day after receipt. The dispatch date counts; Drapeur does not need to receive the parcel within this period. The customer retains proof of dispatch. This rule does not reduce statutory withdrawal rights.
Items must be carefully protected and accompanied by their accessories. Customers are asked to keep the original tags and packaging. Under the statutory right of withdrawal, their absence alone does not justify automatic refusal. The customer can only be held liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, under the statutory conditions.
6. Return costs and refunds
The customer pays the direct costs of a change-of-mind return. For France, a Chronopost label is offered for €6, deducted from the refund or store credit when used. Outside France, the customer arranges return shipping at their own expense using a carrier that delivers directly to the return address. Returns to pickup points are not accepted.
Costs necessary to resolve a preparation error or exercise a statutory guarantee are not charged as a change-of-mind return. The customer contacts customer service to arrange this.
In the event of withdrawal, the refund is made no later than fourteen days after notification. Drapeur may withhold it until the goods are recovered or proof of their dispatch is received, whichever occurs first.
For withdrawal from the entire order, the refund includes the initial delivery charges corresponding to the standard delivery method offered. The surcharge for expressly choosing a more expensive method is not refunded. For a partial return, charges that remain payable for shipping the items retained are not refunded.
The refund uses the original payment method unless the customer expressly agrees to another method at no cost. The indicative bank processing time of three to five working days after processing is separate from the statutory refund deadline.
7. Store credit and exchanges
At the customer's request, store credit may be issued as a gift card valid for one year on the website or at the Biarritz showroom. It is not a mandatory substitute for a statutory refund.
A size exchange may be offered subject to stock availability. Any charges are communicated before the customer agrees. Detailed commercial conditions appear on the returns page, subject to the statutory rights set out in these terms.
8. Statutory guarantees
Drapeur is liable for lack of conformity and hidden defects under the conditions provided by law. To exercise these rights, the customer contacts contact@drapeur.com or writes to the registered office, identifying the order and the issue encountered. The fifteen-day commercial return period does not apply to claims under a statutory guarantee.
Statutory information — sale of goods
The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity becomes apparent. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it arose.
Where the contract for the sale of goods provides for continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the agreed supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or service, not the date on which it arose.
The statutory guarantee of conformity requires the professional, where applicable, to provide all updates needed to maintain the conformity of the goods.
The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.
If the consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for two years from the replacement date.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° Repair or replacement takes place more than thirty days after the request;
3° Repair or replacement causes major inconvenience to the consumer, particularly where the consumer ultimately bears the cost of taking back or removing non-conforming goods, or the cost of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious as to justify an immediate reduction or termination. In that case, the consumer is not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the goods are returned in conformity.
The above rights arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained, or a full refund in exchange for returning the goods.

These terms are governed by French law, without depriving the consumer of any mandatory protective provisions applicable to them. Jurisdiction is determined by the statutory rules; the consumer is not subject to the exclusive jurisdiction of courts in Paris or Bayonne.
